  • A McLoughlin Middle School volunteer tutor faces misdemeanor sex abuse charges for allegedly engaging in sexual contact with a girl at the school, police said.
    School officials contacted Medford police on Feb. 9 to report that Omar Daniel Alvarez-Garcia, 18, had engaged in inappropriate sexual behavior involving an underage student.
    Alvarez-Garcia was terminated from his position as a science tutor and was banned from school property, Medford police Detective Sgt. Mike Budreau said.
    After his termination, Alvarez-Garcia attempted to return to the school and was cited for trespassing by a Medford school resource officer.
    An investigation by Medford sex crimes detectives found that Alvarez-Garcia had befriended the student and that the two had sexual contact at the school, police said.
    There were three incidents involving the student that happened on or around Feb. 2, police said.
    Alvarez-Garcia was charged with three counts of third-degree sexual abuse and is lodged in the Jackson County Jail on $12,000 bail.
    Third-degree sexual abuse is a misdemeanor. Under Oregon law, a person commits the crime when he or she subjects another person to sexual contact without the victim's consent or the victim is incapable of consenting because he or she is under 18 years of age.
    Budreau praised the quick response by the school after learning of the possible sexual contact between Alvarez-Garcia and the student.
    "They took immediate action and fired the tutor and trespassed him from the school," Budreau said. "They then called us to begin the investigation."
    Budreau said Alvarez-Garcia was not a paid employee of the school district and that he gave his time to help students with their science homework.
    "He will not be returning to the school," Budreau said. "We are going to continue our investigation into this case."
    If convicted on the sex abuse charges, Alvarez-Garcia might have to register as a sex offender. (Correction: This story has been updated to reflect that a requirement to register as a sex offender if convicted of third-degree sexual abuse is decided during trial and sentencing.)
